Terms of Service

Please read these Terms of Service carefully before using PathScorer. They constitute a legally binding agreement between you and PathScorer. We have written them to be as clear and readable as possible, but the uppercase sections in clauses 8 and 9 are legally required to be in that format.
1. Acceptance of Terms
By accessing or using PathScorer (the "Service") at pathscorer.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.
2. Description of Service
PathScorer is a career intelligence platform that scores your skills and experience against occupational data from the U.S. Bureau of Labor Statistics (BLS) Occupational Employment and Wage Statistics (OEWS) programme and the O*NET database. The Service produces ranked career match reports, salary benchmarks, skill gap analyses, and career transition plans. The Service is provided "as is" for informational purposes. Career outcomes depend on many factors beyond the scope of any scoring algorithm.
3. Accounts
You may use certain features of the Service without registering. To save analyses and access premium features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately at support@pathscorer.com if you suspect unauthorised access. You must be at least 16 years old to create an account.
4. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose or in violation of any regulations; (b) attempt to reverse-engineer, scrape, or extract the underlying occupational data or scoring algorithms; (c) use automated tools (bots, scrapers) to access the Service at scale without written permission; (d) submit false or misleading profile information with the intent to manipulate results; (e) reproduce, republish, or resell the Service or its outputs as a competing product; or (f) attempt to gain unauthorised access to any part of the Service or its infrastructure.
5. Paid Plans and Billing
Certain features require a paid subscription. Prices are listed on the pricing page and are in USD unless otherwise stated. Subscriptions are billed in advance on a monthly or annual basis. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Refunds are issued at our discretion for unused periods within 7 days of a charge if the Service has materially failed to deliver as described. Payment processing is handled by Stripe, Inc. We do not store full card numbers.
6. Intellectual Property
The PathScorer platform, its scoring methodology, visual design, and original content are the intellectual property of PathScorer and are protected by applicable copyright and trade secret laws. The underlying occupational data (BLS OEWS, O*NET) is produced by the U.S. government and is in the public domain. You retain ownership of the career profile information you provide. You grant us a limited licence to process that information to deliver your analysis.
7. Data and Privacy
Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT CAREER MATCH SCORES WILL RESULT IN EMPLOYMENT, SALARY INCREASES, OR ANY SPECIFIC CAREER OUTCOME. SALARY DATA IS BASED ON GOVERNMENT STATISTICS AND MAY NOT REFLECT YOUR LOCAL MARKET CONDITIONS AT THE TIME OF USE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PATHSCORER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $50 USD.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease. Sections 6, 8, 9, and 11 survive termination.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes by emailing registered users or posting a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
